Terms & ConditionsDeftware
The following Terms & Conditions govern your access to and use of the website, platform, and services provided by Deftware. By accessing, registering for, or using any of Deftware’s services, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree to these terms, you must refrain from using the services.
Deftware provides cloud-based enterprise resource planning (ERP) and business management solutions delivered as Software-as-a-Service (SaaS). The services include system access, hosting, maintenance, updates, and support according to the subscription plan selected by the customer. Deftware reserves the right to modify, suspend, or discontinue any part of the services at any time, with reasonable notice where applicable.
To use the services, you must create an account and provide accurate, complete, and up-to-date information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Deftware shall not be liable for any loss or damage arising from unauthorized access caused by your failure to safeguard your login information.
Access to paid services requires an active subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the selected plan. All payments are non-refundable unless explicitly stated otherwise in writing. Failure to complete payment on time may result in suspension or termination of access to the services. Deftware reserves the right to change pricing, subscription features, or billing terms at any time, provided that such changes do not affect the current billing period.
If Deftware offers a free trial, it is provided solely for evaluation purposes and may be limited in duration or functionality. Deftware reserves the right to terminate or modify the trial at any time without prior notice. At the end of the trial period, access to the services may be restricted unless the customer upgrades to a paid subscription.
You agree to use the services only for lawful business purposes and in compliance with all applicable laws and regulations. You must not misuse the services, attempt to gain unauthorized access to systems or data, interfere with system performance or security, or copy, resell, sublicense, or exploit the services without prior written consent from Deftware.
All data entered, uploaded, or generated by the customer within the ERP system remains the property of the customer. Deftware does not claim ownership of customer data and acts solely as a data processor for the purpose of providing the services. The customer is fully responsible for the accuracy, legality, and content of the data stored within their ERP instance.
Deftware implements reasonable technical and organizational measures to protect customer data and ensure system security. However, while Deftware strives to maintain high availability and reliability, uninterrupted or error-free operation of the services cannot be guaranteed. Scheduled maintenance, system updates, or unforeseen technical issues may result in temporary downtime.
All intellectual property rights related to the platform, software, website, branding, documentation, and content provided by Deftware remain the exclusive property of Deftware or its licensors. These Terms & Conditions do not grant the customer any ownership rights in the software or services, except for a limited, non-exclusive, non-transferable right to use them during the subscription period.
Deftware reserves the right to suspend or terminate access to the services if the customer violates these Terms & Conditions, fails to pay subscription fees, or uses the services in a manner that may harm Deftware, other customers, or third parties. Upon termination, access to the services will be disabled, and customer data will be retained or deleted in accordance with Deftware’s data retention policy.
To the maximum extent permitted by applicable law, Deftware shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to the use or inability to use the services. Deftware’s total liability for any claim shall not exceed the amount paid by the customer for the services during the most recent billing period.
You agree to indemnify and hold harmless Deftware from and against any claims, damages, losses, or expenses arising from your use of the services, violation of these Terms & Conditions, or violation of any applicable laws or third-party rights.
Deftware may update or modify these Terms & Conditions from time to time. Any changes will become effective upon publication on the website. Continued use of the services after such changes constitutes acceptance of the updated terms.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which Deftware operates, without regard to conflict of law principles. If you have any questions regarding these Terms & Conditions, you may contact Deftware through the official communication channels provided on the website.
